At ELYSIUM REAL ESTATE SPAIN, we work to ensure that the purchase of your property is a smooth, secure, and hassle-free process. To this end, we offer you our Customer Service Department (DAC), which will accompany you every step of the way, from the initial stages to any post-purchase needs, guaranteeing a friendly, efficient, and fully personalized service.
From the moment you formalize the reservation of your property, we will assign you a Personal Manager, who will contact you to provide you with close and professional support throughout the entire process.
Your manager will keep you informed of every step of the process, guide you through the steps to follow until the property is handed over, and answer any questions you may have along the way.
If at any time you need to resolve a query or manage any aspect related to your property, you can contact your Personal Manager directly, who will provide you with a quick and accurate response, coordinating everything necessary to ensure you have a flawless experience.
This “Buying Guide” provides a simple overview of all the stages involved in purchasing your new property. Our aim is to offer you an exceptional experience at every step of the way and to thank you once again for the trust you have placed in us.

STEP 0: ADVANCE BOOKING
Preparation process for purchasing any property with ELYSIUM REAL ESTATE SPAIN.
Once you have chosen your property, your sales advisor will ask you for the following information and documentation (copies will be made of all documents) in order to formalize the reservation of your property:
Buyer identification: - If you are buying as an individual: a valid PASSPORT or NIE (Foreigner Identification Number). - If you are buying as a legal entity/company:
- TAX IDENTIFICATION NUMBER and deed of incorporation and/or certificate from the Commercial Registry that proves the business identity.
- Valid passport or NIE (Foreigner Identification Number) of the administrator or authorized representative signing the reservation document. In the case of proxies, a notarized power of attorney is required; in the case of directors, their authority to represent the company must be demonstrated in the articles of incorporation or in the deed of appointment of director, or by means of a certificate from the Commercial Registry of the corresponding country.
- Valid passport or NIE (Foreign Resident Identification Number) of all shareholders holding 25% or more of the company’s shares or equity interests.
The registry and legal documents must be translated into Spanish; if necessary, they must bear the Apostille of the Hague Convention.
Completion and signing of the “Know Your Customer” (KYC) document for anti-money laundering purposes by each buyer, and submission of any required documentation.
If the buyer is a company, along with the KYC signed by the administrator or attorney, all shareholders with holdings equal to or greater than 25% of the company must also complete and sign it. The balance sheet and profit and loss account must also be submitted, without prejudice to any other documentation required.
Identification of the property, as well as the annexes that are part of the purchase and details of the payment structure agreed upon with the signing of the reservation document, along with the specifications of the property and the property plan (if any). These documents can be signed in person at our offices when making the reservation or electronically through the SIGNATURIT platform.
Payment of the deposit for the amount determined by ELYSIUM REAL ESTATE SPAIN. Once paid, it will be necessary to verify the origin of the funds by means of a certificate confirming the identity of the holder of the bank account from which the deposit was made and from which all future payments for the purchase of the property will be made, together with proof of payment.
The property will be considered formally reserved once ELYSIUM REAL ESTATE SPAIN has received all the documentation, complete and signed, and the payment of the reservation deposit.
ELYSIUM REAL ESTATE SPAIN is obligated to actively cooperate with the prevention of money laundering and to comply with all European Union policies and protocols in this regard, regulated in Spain by Law 10/2010 and its implementing regulations, and expects the same conduct from its clients. By complying with these regulations, we help ensure that the money used to purchase properties is obtained legitimately and does not come from criminal activities. This helps protect both buyers and sellers, maintains a fair and transparent real estate market, and contributes to a safer and more reliable business environment in Spain.
Therefore, we are required to verify that all funds used by you for the purchase of your new property in Spain have been legally obtained.
Compliance with these requirements is mandatory. Therefore, we kindly ask you to consider the following:
ELYSIUM REAL ESTATE SPAIN will not accept payments from third parties, that is, people or companies other than the signatory of the contract, unless explicitly approved and identified by the person making the payment on behalf of the signatory of the reservation.
Personal checks, cash, or funds originating from a country or region considered high-risk will not be accepted.
STEP 1: SIGNING THE PURCHASE AGREEMENT
Once the reservation is formalized and the Money Laundering prevention process is completed, you will receive an e-mail or communication from your Commercial Advisor with the following documentation:
a. Draft of the purchase agreement. b. Map of the property (if any) c. Copy signed by both parties (buyer-seller) of the reservation document, which will include the amounts, the terms of execution thereof, and conditions thereof. d. Official document of the municipal cadastre with the registration data of the reserved property. e. Updated simple registration note f. In the event that the property is a new construction, a Technical Specifications Report, Plans, and Expected Delivery Dates.
To facilitate the signing process, ELYSIUM REAL ESTATE SPAIN will send you a generic contract in your native language along with the contract in Spanish. Before sending the purchase contract for signature, you must provide the Certificate(s) of Bank Ownership with which all purchase payments will be made, as well as any other information that your agent indicates. Please note that without this certificate, the purchase contract cannot be issued.
Once you have provided the documentation and reviewed the paperwork, the next steps to follow are as follows:
Digital signature via the Signaturit platform: Signaturit is a digital signature solution that allows us to sign sales contracts and other documents electronically. We use Signaturit because it simplifies the signing process, saving time and resources. It offers a secure and legally binding way to sign contracts from anywhere, at any time, and from any device with an internet connection. With Signaturit, our customers can sign contracts easily and efficiently, eliminating the need to print, scan, and send physical documents by email. It guarantees the integrity and confidentiality of signed contracts and provides a transparent audit trail for legal and regulatory compliance purposes.
To start the process, you will receive an email link. Click on it and you will be redirected directly to the Signaturit platform, where you can verify and sign the document at the end of the process. You can sign from any device with internet access, such as a mobile phone, tablet or computer. Once signed, our representative will proceed to sign. Once both parties have signed, you will receive a duly signed and legally valid copy of the contract by email, which means that the signing process is complete.
Please note that to perform this process, each of the buyers will need to provide an individual and person email address
Manual signature: If digital signature is not possible, the procedure is as follows:
- Print two copies of the documents received in Spanish
2. Sign all pages on both copies.
3. Mail both signed original copies to the address provided by your sales consultant.
4. Pay the amount specified in the contract.
5. Finally, the signed purchase contract will be sent by registered mail to your postal address.
Once these steps are completed the documentary part of the Sales Agreement will be formalized, remember that for the formalization to be complete you must pay the payment of the contract in the bank account indicated in it.
* When making any payment by bank transfer, please verify that the bank account to which the transfer is made is one of those indicated in the reservation documents/private contract.
STEP 2: PAYMENT GUARANTEES FOR HOUSING UNDER CONSTRUCTION.
ELYSIUM REAL ESTATE SPAIN has a policy that covers all installment payments received during the construction process, in accordance with the provisions of the Building Planning Act. This policy does not cover any property whose construction has already been completed.
The construction process shall be deemed to be completed once the property has obtained final expert approval. Once ELYSIUM REAL ESTATE SPAIN receives the signed contractual documentation and the corresponding payment, we will proceed to request the corresponding document (Policy or Guarantee, depending on the promotion). This process takes approximately 30 business days.
ELYSIUM REAL ESTATE SPAIN will send you the policy document by email using the Signaturit digital signature platform to obtain your signature, or the bank will send you a copy. Once the document is signed by all parties, you will receive a signed and legally valid copy by email, at which time the signing process will be completed.
If we cannot send the documents through Signaturit, we will send them by registered mail. If the policy is a guarantee, you will receive three copies: one for you and the other two must be signed and returned by ordinary mail to ELYSIUM REAL ESTATE SPAIN.
If the document is a bank guarantee or an insurance policy, you will receive the original document which must be returned to the person representing ELYSIUM REAL ESTATE SPAIN on the day of signing the notarial deed.
When making any payment by bank transfer, please verify that the bank account to which the transfer is made is one of those indicated in the reservation documents/private contract.
STEP 3. DELIVERY OF YOUR HOUSE
We want the delivery of your home to be as simple and hassle-free as possible. Therefore, you will find below a detailed description of the steps to follow during this process:
A. Notification of the initiation of proceedings concerning the drafting of the deed.
ELYSIUM REAL ESTATE SPAIN will notify you when it starts arranging the signing of the deed, once we have the necessary documentation. In this communication, you will be asked to provide us with certain information before signing the deed:
- Contact details, if you have a lawyer, representative or mortgage company.
- The identity document of the buyer or buyers.
– Foreigners: Copy of passport and Foreigner Identification Number (“NIE”)*. – Spanish citizens: Copy of National Identity Document.
- If a legal representative signs on your behalf, you must also send us:
– A copy of the power of attorney authorizing the legal representative who will sign on your behalf.
– A copy of the legal representative's identity document.
- The originating bank account number** from which you have made payments to ELYSIUM REAL ESTATE SPAIN
*This is very important in order to be able to subsequently contract for water, gas and electricity supplies, to be able to register the property and pay the corresponding taxes within the legally established deadlines.
***This is essential in order to sign the deeds, since legally the buyer(s) of the property must all be holders of the accounts from which the payment is made.
In the case of a company, the following documents will also be required:
- Copy of the identity document of the company representative (NIE/Passport).
- Tax Identification Certificate.
- The company's bylaws.
- Identification of the ultimate beneficial owners of the company with a stake exceeding 25%.
- Purchase authorization issued by the General Meeting of Associates if it is a critical asset.
If a legal representative signs on your behalf, you must also send us:
- Copy of the power of attorney in favor of the legal representative who will sign on behalf of the company.
- Copy of the legal representative's identity document.
B. PROPERTY INSPECTION
- Before signing the deed, we will arrange a property inspection. This inspection will be conducted by an ELYSIUM REAL ESTATE SPAIN supervisor who will show you the property's condition for your peace of mind.
C. SIGNING OF THE DEEDS
On the day the deed is signed, or the day before, you must pay the outstanding balance of the transaction. This can be done in two ways:
- On the same day as the signing of the deed and at the notary's office, by means of a certified bank check issued by a Spanish bank in favor of… (owner)” for the outstanding balance of the transaction.
- By bank transfer of the outstanding amount of the transaction, which must have been received in the account of… (owner) 72 hours before the day on which the deed must be signed.
**When making any payment by bank transfer, please verify that the bank account to which the transfer is made is one of those indicated in the booking documentation/private contract.
During the signing of the deed, a Legal Representative of ELYSIUM REAL ESTATE SPAIN will hand over the keys to the property. Finally, it is very important that, before planning your trip, you coordinate and confirm the exact date of the deed signing with your Personal Manager, as this date may vary depending on the availability of banks, notaries, lawyers, and legal representatives.
STEP 4: PROCUREMENT OF PUBLIC UTILITY SUPPLIES
Once the deeds are signed, the new owner is responsible for arranging electricity, gas and water supplies, if the property lacks them.
Sometimes a property may be handed over without utilities connected. Here we explain how to contract for electricity and water services. To facilitate this process, ELYSIUM REAL ESTATE SPAIN offers a service that allows us to manage the contracts for your property's electricity, gas, and water meters.
This service is optional and has an additional cost of €300 + 21% VAT, which must be paid separately through a single bank transfer to ELYSIUM REAL ESTATE SPAIN.
This amount does not include connection fees for these services, which will be billed directly to the customer by the corresponding water, gas, or electricity supplier. The cost of these fees may vary depending on the property's location.
In order for ELYSIUM REAL ESTATE SPAIN to register you with these public services and for us to establish direct debit agreements for invoices that your suppliers will issue from then on, you will need to provide us with the following documentation:
- A copy of the NIE (Foreigner Identification Number) of the buyer or buyers along with a photocopy of their passport(s).
- A bank account at a Spanish bank.
- A signed authorization to carry out the necessary procedures
If the documentation is not received, we will not be able to formalize the water meter contract and the property will be handed over without a water supply.
